1. General Conditions
We reserve the right to refuse service to anyone for any reason at any time.
Prices, product availability, and shipping policies may change without notice.
You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the site or products without our express written permission.
2. Product Information
We specialize in O-scale model trains, including new, like-new, and gently used items. Product condition, road numbers, scale, and compatibility details are included in each product listing.
All descriptions and images are provided to the best of our knowledge. We are not liable for any inaccuracies beyond reasonable control.
3. Order Processing & Shipping
Orders are typically processed within 1–2 business days.
All orders ship from Des Moines, Iowa.
Tracking information will be provided once the order has shipped.
Shipping timelines are estimates and not guaranteed.
4. International Orders
We do ship internationally. However, international buyers assume all responsibility for customs duties, import fees, shipping delays, and potential loss or damage.
We strongly recommend purchasing insurance for international orders. Thomas and His Trains is not responsible for packages once they leave the United States.
5. Returns & Refunds
Except as required by applicable law, all sales are final unless Thomas and His Trains approves a cancellation, return, or refund in writing.
Any approved cancellation, return, or refund requested because the customer changed their mind, ordered the wrong item, no longer wants the item, or made an ordering mistake is subject to a 10% restocking fee, calculated from the merchandise subtotal and deducted from the refund. Original shipping charges, shipping insurance, expedited-shipping charges, and other service fees are non-refundable. Orders cannot be canceled after shipment.
The 10% restocking fee does not apply when Thomas and His Trains sent the wrong item or confirms a manufacturer defect. Pre-orders after the applicable deadline, custom runs, personalized or special-order items, deposits, and clearance or final-sale merchandise are not eligible for cancellation, return, or refund except as required by applicable law or agreed by us in writing. The complete Refund Policy controls all return and refund requests.
6. Payment & Security
We accept major credit cards, PayPal, Shop Pay, and other secure payment methods through Shopify.
All transactions are encrypted and processed securely.
7. Limitation of Liability
Thomas and His Trains shall not be liable for any direct or indirect loss, damages, or expenses related to the use of our products or website.
8. Governing Law
These Terms are governed by the laws of the State of Iowa, United States. Any disputes shall be handled in the appropriate courts of Polk County, Iowa.
